Other preferential claims One of the former employees of the bankrupt has submitted a preferential claim in respect of wage arrears and the costs of filing for bankruptcy. However, this claim has not yet been substantiated with verifiable documents, so that this preferential claim has been placed on the list of provisionally allowed preferential creditors as PA.
Cause of the bankruptcy
According to the managing director of the bankrupt company, the bankruptcy is due to a conflict with two former employees of the bankrupt company. This conflict has escalated completely, with, among other things, criminal declarations being made on both sides. The managing director of the bankrupt company has indicated that he needed all his time for this conflict and could therefore no longer be active in the management of the company. In addition, the director would have been threatened, which meant that he also temporarily hid.
In the end, one of these former employees filed a application for the bankruptcy of the bankrupt, as well as of the statutory director, in connection with claims she would have against the bankrupt and the statutory director of the bankrupt. This concerns, on the one hand, a wage claim and, on the other hand, a claim on account of forfeited penalty payments in connection with, among other things, defamation and slander.
The statutory director of the bankrupt did not appear at the bankruptcy hearing because he felt threatened.
